They think that if the FSF were to crack down on such small-time violations, it would strongly discourage many would-be open-source developers.

If the FSF weren't going to crack down on "small-time" violations, they'd probably lose the right to enforce the distribution clauses. If you allow it for one, you have to allow it for all. If Mepis and DSL can knowingly violate the license and be blessed by the FSF, I could claim estoppel, violating the GPL with my "Multi-Billion Dollar GPL Violating Linux Distro"

If you don't have the skills or the pecunias to roll your own GPL distro, don't start one. If you can't abide with the GPL, you don't have distribution rights, period.
