Fight FUD with FUD?

I think this illustrates, however, how fragile all positions are in regards to patent issues. Apple or Xerox or who knows who could very easily sue MS for something that may be frivolous (in the long run) but which might have merit in the short term (until a court decides it's goofy).

"Let he who is without patent infringement throw the first lawsuit."

But the GUI thing was already tried in court... http://en.wikipedia.org/wiki/Apple_Computer,_Inc._v._Microso... Apple sued Microsoft, and Xerox sued Apple ;) Both cases were dismissed (but for different reasons).

Right, but something similarly ridiculous could happen again.
