SCO keeps changing its story of "infringement", and so over the years, we've tried to track all the twists and turns, comparing their allegations with evidence available on the Internet or in our collections. SCO made it harder when it removed its collection of press releases from its site and from the Internet Archive. I had forgotten all about it, but years ago, before they did that, I had saved their list of older press releases, meaning for us to eventually look at all of them. Then, they disappeared, and I just stumbled across the information again now, and I'd like to share it with you. Even the names of the press releases could be useful. If anyone gets sued at any point, at least they'll know what to ask for in discovery. I also discovered a wonderful site, Sourcewire that still has tons of Caldera press releases from 2001.
Here's one I found there, the announcement about OpenUnix 8. That's the one with LKP, the Linux Kernel Personality. Guess what LKP included?
The LKP technology in Open UNIX 8 will include the same GNU tools and
libraries built into Caldera OpenLinux(tm), which were developed with
close
adherence to the specifications of the proposed Linux Standards Base
(LSB).
Open UNIX 8 will track this developing standard, assuring the highest
degree
of application compatibility.
Libraries, eh? How fascinating. Isn't this fun? And what a dovetail, in that we just showed you what was included in OpenLinux. I have some more to show you on that in a later article. But do you see how valuable all scraps of information are? You just never know when it will matter in litigation, somewhere, some time.
Here's a Caldera press release from April of 2001, announcing a free preview of AIX 5L, the result of the joint work on Project Monterey. Remember SCO telling the court how they didn't know about Linux? heh heh:

We've certainly been served a heaping portion of dancing baloney over the years. If you'd like to help, please see if you can find any of the Caldera press releases from its website's list still on the Internet anywhere. I discovered that if you plug in the title of the press release into Google, with or without quotation marks, you'll sometimes find it. Google Groups, for example, has this announcement about Caldera shipping Wabi 2.2 for Linux, in 1996, which it could do by licensing it from Sun. And one of the press releases announced Caldera distributing the 2.4 Linux kernel for the first time, in OpenLinux Workstation 3.1.
I'm preserving the links, but you won't find them there any more or on Wayback, last I looked. What you can do to help is try to find the titles on Google or your favorite search engine. From Sourcewire, I found the Caldera announcement in 2001 about closing the deal with Santa Cruz. It says what Caldera got was the business, the server software and professional services divisions, and "the UnixWare and OpenServer technologies": May 7, 2001 - Caldera Systems, Inc. Indeed. Within days, Caldera put out this announcement about its new Professional Services: Caldera International, Inc. (Nasdaq: CALD), the only
company "Unifying UNIX with Linux for Business," today introduced its
Professional Services offerings.
Through the acquisition of SCO's Professional Services Division, Caldera has
obtained a 20-year track record in delivering UNIX and Linux solutions and
gained a presence in the small footprint and dedicated function systems
markets. Caldera has already completed a number of UNIX and Linux projects
in this market space including POS terminals, gaming platforms, appliances,
customized desktop clients and speibibliot servers....
"Caldera's Professional Services team helped us migrate our entire gaming
software from Microsoft Windows to the Linux platform and produce a
low-cost, ground-breaking product with outstanding performance and
functionality," said Elaine Hodgson, president and CEO of Incredible
Technologies.
What a difference a year makes.
The Sourcewire list includes this gem from 2001, Caldera's announcement about OpenLinux Workstation release 3.1:
"Our new Workstation product is an ideal environment for developing on Linux
or developing for Linux-compatible platforms such as Caldera's Open UNIX 8,"
said Drew Spencer, chief technology officer at Caldera. "For the
development lifecycle, it provides developers the necessary tools to build,
test and deploy business applications in a secure, supported, and scalable
server setting - while developing in an easy to use, developer-friendly
environment."
Here's another beaut, from the same year, May 14, 2001, all about how you could join the Caldera Developer Network for free, a combined Unix and Linux developer environment: Caldera International, Inc. (Nasdaq: CALD), the only
company "Unifying UNIX with Linux for Business," announced today the launch
of the Caldera Developer Network.
Caldera developers, including Independent Software Vendors (ISVs),
Independent Hardware Vendors (IHVs), corporate in-house developers and
members of the Open Source developer community, will have early access to
UNIX and Linux technologies, allowing them to develop on UNIX, on Linux, or
on a combined UNIX and Linux platform. This, plus the network's worldwide
support and additional services, will enable members to build and develop
their products with globally portable applications and get to market faster.

resources, tools and support they need to build applications and drivers,

services at no cost. More extensive, fee-based support services, including
migration assistance, engineering and educational services, are available.
In addition, members have access to the private developer lounge. In this
password-protected area, developer partners can purchase products directly
at discounts and receive free online technical support and other services.

Of course, from 2003 on, you could get sued for migrating from OpenServer to Linux. Now, compare all this material, plus the prior article on Santa Cruz's Linux Strategy, with the testimony of Dion Johnson [PDF] and David McCrabb [PDF], who each provided declarations in support of IBM's motions for partial summary judgment, which have not yet been ruled on, having been stayed by SCO's filing for bankruptcy protection. I see a close match. See what you think.
