Mr. Michaelson is being too specific here. And in doing so he shows his hand.

SOX applies in equal measure to the GPL as it does to MS Eula.

Let's take his example-If a company takes stolen MS Windows source and includes it in their product and makes a claim that they own the product. Are they not misrepresenting the facts? Are they then not liable under SOX?

I suggest a more interesting exercise for Mr. Michaelson- Explain why the SOX does not apply to the MS EULA.
