In reading through the latest earnings announcement from SCO Group, the burning question is whether the company will be around to collect even if it should win the lawsuits it has pending against IBM, Novell, and AutoZone. The IBM case, which is likely to be the first one up, is not scheduled for trial until February 2007. Meanwhile, the company has less than $13 million of cash on hand, and is spending more than $2 million a month on average -- you do the math.
Any sudden infusion of cash into SCO from an outside source (I.E. MS) will result in massive bad publicity throughout the industry. Very few wish to become one of IBM's long term enemies.
IBM is very unlikely to wish to settle. It would send the wrong message. They look beyond the present and wish to prevent every Tom, Darl, and Henry from trying the same tactic. However, if they legally grind SCO into powder, that sends a much different message.
The big question now is whether it is IBM or Novell which rips SCO to pieces.
Not just IBM's enemy, but the enemy of pretty well every company involved in Open Source.
Plus, the funds donated that don't end up in the lawyers' pockets, are likely to end up in Novell's pockets.
