While CIA Agent Carl Cummings was being taught to heel, Frank was sitting at his kitchen table, tapping away at the cramped keyboard of a cheap netbook connected to a neighbor’s unsecured WiFi network. Even this was risky, he reminded himself, so this brief session would have to be his last until he moved on.

Hundreds of organizations that develop and promote standards have been formed using a legal and governance model that leads them to be referred to as "consortia." At 9;00 AM EST today, the parties to Jacobsen v. Katz filed a settlement agreement with the U.S. Federal District Court for the Northern District of California. In doing so, they brought an end to one of the most important legal cases to date affecting the continued success of Free and Open Source Software (FOSS). My blog entry earlier this week noting the silent passage of the 100 day mark for CodePlex sparked a call from the Foundation's PR firm, and an opportunity for me to spend an hour on the phone with Sam Ramji, the interim President of the Foundation, and Foundation Deputy Director Mark Stone during which we covered a lot of ground.

All Quiet on the CodePlex Front as 100 Day Mark Passes

As you may recall, Microsoft announced back on September 10 that it had launched a new, open open source organization called the CodePlex Foundation. It also pledged to announce a new board within 100 days - which passed without comment 11 days ago.
